COPYRIGHT.
The copyright in all photographs created by Colourbox Photographers shall remain in the property of Darryl Everitt and Beder Kaddouri in accordance with the Copyright Designs and Patents Act 1988.
Unless permisssion has been given in writing, the clients shall have no right to reproduce, nor to authorise the reproduction of, by any means whatsoever, any photographs created by us. This includes, scanning into a computer, photographing with an electronic camera, including a video camera, and producing either a hard copy on paper, film, or similar medium and also recording an electronic image on a computer hard disk, or any tape, disk or other recording medium.
The client hereby acknowledges that infringement of Darryl Everitt and Beder Kaddouri of Colourbox Photography copyright, is unlawful and maybe a criminal offence.
NEGATIVES/ DIGITAL FILES.
All digital files created by any photographer employed by us shall remain the property of Colourbox Photography who undertake to store all such files safely and make them available for future reproduction for a period of five years from the date of the booking. Photographic prints will become and remain the property of the Client(s). However, the client(s) specifically acknowledge that ownership of prints does not imply ownership of the copyright of the images on them, or any right to reproduce, or authorise the reproduction of such images unless our written permission has been granted in advance.
ADVERTISING.
On making a booking with Colourbox Photography and any of it's partnering photographers. Heather Brown, Beder Kaddouri, Darryl Everitt, Jan Kaddouri and Timothy Burt the school, nursery or college has granted permission for Colourbox Photography to use images of the pupils for producing literature that can be used for advertsing and promoting our services to other schools, nurseries or colleges and also for use on our web site which will be viewed by related bodies and the general public.
It is the schools responsability to ensure that parents are made aware that we have gained permission to be able to use any image that we take for our own advertsing purposes only..
By accepting us as the photographers, the school nursery or college is aware and grants permission to Colourbox Photography and all it's photographers to use any image for advertising, display material, promotional material and for internet advertising. If the school, nursery or college wishes for us to not do so, they must inform us in writing before the day of photography.
Our liability and responsability.
Colourbox photography take a responsible approach to privacy. We will never sell images on to a third party company or individual. We will use images to advertise our services for promotions to schools, nurseries and colleges only. We will also use images for updating our own web site which can be viewed by any individual.
If any parent would prefer us not to use their childs image for advertising either on the interenet or for advertisng on hard literature to schools nurseries, and colleges, they need to make this clear to us by writing on the order form, or in a sepaerate letter with the photo order reference number and school name.
Parents will need to send the comunication to us directly or via the school/nursery/college whether placing an actual order or not.
Colourbox and all it's photographers will not be held responsible or to blame in any way for any advertising going ahead containg any childs image without the above comunication from parent school, college or nursery prior or post photography.
